Regular Meeting - April 16, 2014

The Mayor and the Board of Trustees of the Village of Tularosa met in a
Regular Meeting on Wednesday, April 16, 2014 at 7:00 P. M. in the Court/Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present: Mayor Ray S. Cordova
Trustee Patrick Garcia
Trustee Ronald Cooksey
Trustee John 'Ray' Telles
Trustee Robert Sainz

Also present was Grants Coordinator Richard Gutierrez and Village Clerk Dianna Brusuelas-Guilez.

Absent: Village Attorney Jefferson Rhodes

At 7:00 P. M. Mayor Ray S. Cordova called the meeting to order asking that all rise and join him in the Pledge of Allegiance to the Flag and the Salute to the flag of the State of New Mexico.

1. Consideration of Agenda and Consent Agenda

Trustee Patrick Garcia moved to consider the agenda and the consent agenda with the removal of Item 5. Trustee Robert Sainz seconded the motion. Trustee Ronald Cooksey requested a correction on the minutes of March 19th referencing item 10, the taking of village vehicles home. Employees are not allowed to take village vehicles home on personal use per village policy. Police Department and EMS Fire personnel are the only ones allowed to take vehicles home but not for personal use. Trustee Garcia also agreed with Trustee Cooksey and asked that during the day the vehicles be parked at the village yard and not at employees homes and make sure everyone is informed.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

2. Unscheduled Correspondence and Public Comments

None

3. Jennifer or Gilbert Gaston-Request traffic control for the St. Francis Fiesta May 10th and 11th 2014

Ms. Jennifer Gaston if the village crews could block off the streets on Saturday for the procession around the church after the 5:00 o'clock mass and Sunday during the fiesta. Ms. Gaston then asked for dispensation from the noise ordinance starting Saturday at noon for the 'yuncasos' and asked for help with traffic control. Mayor Ray Cordova asked the Gaston's to confer with Chuck Wood the Chief of Police and Tim Duran the Field Supervisor.

Trustee Patrick Garcia moved to approve and was seconded by
Trustee John 'Ray' Telles.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

4. Hadley Yates-Presentation of the Greater Tularosa

Hadley Yates made a power-point presentation of the Greater Tularosa
Foundation Downtown Vision and asked the Public to go on the website and present their comments. Ms. Yates showed several existing plazas including the El Paso, Santa Fe and Mesilla Plazas and the vision she has for Tularosa. Ms. Yates knows the concern at the catholic church is parking and addressed the issue noting that there is a property on 3rd and Durazno which the foundation can purchase for parking and is of equal distance from the lot to the door of the church as the current lot is to the door. Ms. Yates proceeded to inform the public that the foundation has purchsed the property where McKinley's Barbershop was and plans to make that into a Welcome Center with public restrooms. Ms. Yates assured the public that the village would not incur any expense and this is a preliminary vision. Mayor Ray Cordova explained that private funding is sought for the plaza because if state or federal funding is used they might say no nativity scenes or no processions etc., for Granado Street they will ask for state funding.

5. Jody Garcia-Sauder-Miller & Associates-Presentation and Request approval of Amendments to contract

7. Information: Resignation of David Sanchez effective April 2, 2014

Mayor Ray Cordova read the resignation letter provided by David Sanchez.

8. Tiffany Koenig-Request to cut down tree on Durazno and 8th Street-postponed from March to April meeting

Ms. Koenig not being present nor Mr. Tom Ross who represented Ms. Koenig at the last meeting, Trustee Patrick Garcia proceeded to say that he went to see the tree on Durazno and 8th Street and agreed with Chief Wood that the accident that occurred there was driver error and that he spoke to Mr. Ross while there. Chief Wood said the Stop sign at that street was moved a little.

9. Rachel Thomas-Many Paws Rescue-clarify our role toward this goal without repercussions impeding the missions statement of Many Paws Rescue and goals of the Village

Rachel Thomas representing Many Paws Rescue which helps people who can't care for their animals. Ms. Thomas said she would like volunteers to help Many Paws Rescue. Mayor Ray Cordova announced that the village will be building a new animal control facility. Trustee John 'Ray' Telles asked where the property is located and the response was at 700 Old Mescalero Road.

10. Cecil Lynn-(1) Request annexation of 20 plus acres to Village of Tularosa (2) Request connection to village water system. Property has had city water since 1975 ( will exchange water rights for 17 acres)

Mr. Cecil Lynn made a presentation of the property known as Kontiki Subdivision and would like permission to increase the size of a 2” line to a 6” line and build an additional 40 homes. Village Clerk Dianna Brusuelas-Guilez asked Mr. Lynn if his property was located outside the village limits, Mr. Lynn answered yes.

Trustee Ronald Cooksey asked David Shields from Bohanon-Huston if he had an opinion on furnishing Mr. Lynn water. David Shields said right now the village has 8 billion dollars worth of lines that need to be replaced inside the village.

Mayor Cordova asked what Mr. Lynn would be using for wastewater. Mr. Lynn replied that they would use septic tanks. Mayor Cordova suggested talking to Pat Guilez to see where the water line runs to.

Trustee Ronald Cooksey moved to table until the Board was better informed. Trustee John 'Ray' Telles seconded the motion.

Mayor Ray Cordova asked if the village was not able to supply Mr. Lynn with water what would he do. Mr. Lynn replied that he would dig wells.

11. Valarie Delgado-Approval of adoption of Resolution 2013-2014-23 Budget Adjustments-Increases and Decreases

Trustee Patrick Garcia moved to approve the adoption of Resolution 2013-2014-23 Budget Adjustments-Increases and Decreases. Motion was seconded by Trustee Robert Sainz.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

12. Dianna Brusuelas-Guilez-Approval of adoption of Resolution 2013-2-14-24 for improvements to the property at 385 Central

Trustee Patrick Garcia moved to approve the adoption of Resolution 2013-2014-24 and was seconded by Trustee John 'Ray' Telles,

13. Approval of adoption of Resolution 2013-2014-25 Colonias Infrastructure Project Fund Loan/Grant Agreement documents for $849,982.00

Trustee Robert Sainz moved to approve the adoption of Resolution 2013-2014-25. Motion was seconded by Trustee Patrick Garcia.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

14. Old Business

Trustee Ronald Cooksey asked if the brakes were fixed on the old Dump Truck. Mayor advised that Rick Gutierrez was having a Mr. Ramirez looking at it.

Trustee Patrick Garcia asked the status of the American Tower agreement. Village Clerk Dianna Brusuelas-Guilez said that the village had also been approached by Unison who wanted to be the third party administrator between the village and American Tower because Unison feels the village is not getting enough rent from American Tower. Mayor Ray Cordova suggested giving the paperwork to the Village Attorney Jeff Rhodes and ask his advise but he did not feel that a perpetual agreement was a good idea.

Trustee Patrick Garcia asked if the issue with Water Right #61 had been taken care of. Village Clerk Dianna Brusuelas-Guilez said yes that Maurice Hobson and Norvill Bookout brought in the certificate.

Trustee Patrick Garcia also asked about the Boundary Map that Alamotero was working on. It was advised that after Klad Zimmerle passed away the new surveyor was going to work on it.

There being no further business Trustee Ronald Cooksey moved to adjourn and Trustee John 'Ray' Telles seconded the motion. The meeting adjourned at 8:45 P. M.
