Regular Meeting – April 19, 2017

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, April 19, 2017 at 6:00 P. M. in the Court Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Also present was Monica A. Voorbach Village Clerk, Richard Gutierrez Grants Coordinator, and the Village Attorney Jefferson Rhodes

At 6:05 P. M. Mayor Ray S. Cordova called the meeting to order asking that all rise and join him in the Pledge of Allegiance and the Salute to the Flag of the State of New Mexico.

  1. Consideration of Agenda and Consent Agenda

Trustee Robert Sainz moved to consider the Agenda and Consent Agenda.  Trustee Ray Telles, seconded the motion.

Roll Call Vote:  Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye.  Motion carried with all members of the board voting aye.

  1. Unscheduled Correspondence and Public Comments

Gary Miller of 8th St. Sewer Backup that has been happening for the 3rd time and nothing has been done about it.  The past 2 to3 years ago going to redo something their and nothing has been done. Supposedly the Village received money for this issue and nothing has been done. Mr. Miller of the backup in his home.  Would like to know what the Village is going to do.  The Mayor explained that the board is frustrated with this issue of the sewage backup. The Village applied for a Grant 2 to 3 years a ago to replace the lines.  Village received the grant about 2 years ago. But what ever reason not being able to move on this project. Because of an gentlemen that reviews our application and keeps sending it back with errors. Our project coordinator makes his correction and then he submits it back. Today the application is still sitting in his office. Mr. Miller stated, what saved them a little was popping off the caps. Trustee Robert Sainz, stated to add after this long process that has been drawn out for 2 years. The Village went out for bid and was  awarded then, the contractor terminated the contract for what ever reason. The Village had to start the process over again according to the Las Cruces office.  The Village could not just pick the next lowest bidder. Trustee, Patrick Garcia pointed out our  frustration on what has happened and disappointed with how the gentlemen who is handling this project for us. Trustee Garcia realizes that everybody is busy and has jobs to do. Something with this nature should have been taken care of. Mr. Miller said the first time this happened he had to replace floors.

Rudy Myers CES- With the Gordian Group a Co-Operative Education Service Vendor for Job Order Contract.  Explained and discussed the process on how it works. Rudy stated he came to the office in the morning and meet with Mr. Rick Gutierrez, Project Coordinator and Sonya Gililland, Chief Procurement Officer. To explain to her how the process is done. CES- is a Purchasing Coop.  Which is created by the 89 school district that participate from county to cities from any non profit organizations. They sell everything from school buses to pencils and also constructions services. This service saves time and a savings for the communities.

2.      Continued – Unscheduled Correspondence.

Steven Chavez explained in reference to the Sewage backup and that the Council explanation of their concern of this issue.  Steven suggested of how to fix the solution on to temporary fix at a low cost and stop the damage to the home owners. With a liability law suite to the Village and the State liable.  Talking with a few plumbers that it would cost about 23 dollars of replacing a valve. Steve Chavez stated he just wanted to give the information to the Board

Trustee Patrick Garcia discussed the issue of having a budget for dog food. Need to push on getting the animal shelter completed.  He asked Rick Gutierrez, Project Coordinator for an update. Phase III is complete.  Trustee Ray Telles asked if there is any cabinets in the plan and how many phases do we have?  Rick stated 3 Mayor stated we have to apply for another grant to go to the next phase, small communities can't pay out of their own budget. Trustee Patrick Garcia, asked Rick Gutierrez about the fencing going to be done from the Maintenance yard. Rick stated that he had talked to Tim Duran Supervisor of the Maintenance Dept.  to work with the Animal Control Officer.

Roy Telles asked what the status is at the Senior Center of why the construction stopped?  Waiting for Sonya Gililland to receive her certification.  Mr. Telles stated because all the equipment is just sitting their and a big hole so noticeable.   

Michael Gruger suggested that we move the unscheduled correspondence to be moved to last of the agenda.

  1. PNM Mary Parra Declaring a Proclamation commemorating PNM's 100 year anniversary.

Monica Voorbach stated Mary could not be here and would like for one of the Trustee could read the Proclamation and was voted for Trustee Patrick Garcia.

Trustee Patrick Garcia made a motion to approve, Trustee Deanna Montoya seconded the motion

Roll Call Vote:  Trustee Patrick Garcia, aye. Trustee Deanna Montoya, aye. Trustee Robert Sainz, aye. Trustee Ray Telles, Aye. Motion carried with all members of the Board voting Aye.

4.      Approval of Michael Torres, Temporary Employment agreement from 03/28/2017 and will end 06/30/2017 with not more than 35 hours per week as per chapter II, Section 20.01, Paragraph E, of the Village of Tularosa Employment Personnel Policy at $7.50 hour.

 Jen Gruger stated Mr. Torres replace Ryann Boggs and that Mr. Torres is Tremendous asset for the Older American.   

Trustee Patrick Garcia made a motion to approve, Trustee Ray Telles seconded the motion

5.      Rick Gutierrez, to adopt the Proclamation for Fair Housing Day.

Trustee Patrick Garcia read the Proclamation out loud to the public.

Trustee Robert Sainz made a motion to approve. Trustee, Deanna Montoya Seconded the motion.

6.      Rick Gutierrez, Resolution to approve CDBG Planning Grant application for Comprehensive Grant.

Trustee Patrick Garcia made a motion to approve. Trustee, Robert Sainz seconded the motion.

7.      Rick Gutierrez, Resolution to approve submitting CDBG application for Water System Improvements.

Trustee Robert Sainz made a motion to approve. Trustee Ray Telles seconded the motion.

  1. Mayor Ray Cordova, approval of pay increase of $2.00 for Sonya Gililland for completing the 5 day Procurement classes and certified Procurement Officer.

The board asked the Village Clerk, Monica Voorbach for a comment.  Clerk stated the responsibilities as a Procurement Officer and all other duties, as of the business license, covering in the front office when Sally Singleton is out. After further issues were discussed the board made a decision.

Trustee, Robert Sainz made a motion to approve with contingent on a 60 day probation. Trustee, Deanna Montoya seconded the motion.

9.      Jennifer Gruger, Requesting for Granado Street Rd. closure and trash bins May 6th and 7th for the Tularosa Art and Music Festival. 
 
Trustee, Patrick Garcia made a motion to approve.  Trustee, Ray Telles seconded the motion.

  1. Executive Session as per section 10-15 of the Open Meetings Act to discuss the Operation and Use Agreement with Sacramento Mountain Senior Services, Inc.

Trustee Patrick Garcia, made a motion to approve. Trustee, Robert Sainz seconded the motion.

11.    Jennifer Gruger, requesting to approve the operating and Use Agreement with Sacramento Mountain Senior Services, Inc.

In the  discussion with Attorney Jeff Rhodes, Mayor Ray Cordova and Trustees with Jen Gruger and Paula Merrell Executive Director of SMSSI  of the Operating and Use Agreement. Reviewing the agreement and checking off which party is responsible for the following items. Paula Merrell stated that the County agreed to take the Vehicles which they will be transferred to the County. It is agreed the funds from General Fund will be paid for the items that were checked off in the agreement.

Trustee, Ray Telles made a motion to approve. Trustee, Robert Sainz seconded the motion.

  1. Old Business:  Trustee Ray Telles, Asked about the 2 employees that were hired if they have got their certifications.  Not yet.
