Workshop-August 18, 2009

The Board of Trustees of the Village of Tularosa met in a Workshop setting on Tuesday, August 18, 2009 at 6:00 P.M. in the Court/Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Mayor Ray S. Cordova called the Workshop to order at 6:25 P. M. asking that all rise and join in the Pledge of Allegiance.

Trustee McKean-Discuss Personnel matters


Mr. Ernie Byers gave an update on the cement pad at the Wastewater Plant for the Solid Waste trucks showing the Mayor and members of the Board some pictures stating that his contract has been fulfilled and requested the final payment. Mr. Byers stated that he needed to bring the grate for the drainage but need the cement to cure before installing it.

Mr. Klad Zimmerle made a presentation to the Mayor and the Board of Trustees in reference to the proposed Rhino Subdivision at the Southeastern corner of S. Bookout. Trustee Fred Tyler questioned that he saw no curbs or gutters or streets on the plat. Mr. Zimmerle stated that there were two existing streets, St. Francis and Bookout and he has received driveway permits from the state and all the lots will have public access, each lot will be handled on a case by case basis. Trustee Fred Tyler requested a disclosure statement that the Village of Tularosa is not responsible for curb and gutters, water, sewer. Trustee Thomas McKean said the property was not commercial. Mr. Klad Zimmerle read minutes of January 16, 2001 where the village made a motion and the motion passed to make the property commercial. Mr. Dyer the property owner will install sewer and water lines and each lot will have culverts, there will be one driveway for two properties. Mr. Klad Zimmerle said the village needs to get a subdividers contract, he can draft one and Village Attorney Jeff Rhodes can review, plus a disclosure statement with covenants that the developer will be responsible. Mayor Ray Cordova's concern was that the village would have an agreement with the current subdividers and then they sell the property and the new owners would not feel the agreement was with the first property owners not the new ones. Mr. Zimmerle said the agreement he was going to prepare would be tied to the property and binding to the lots. Village Clerk wondered about the 35 day time limit. Mr. Zimmerle said he would send a letter in the morning requesting an extension on the 35 day rule.

Trustee Patrick Garcia moved to adjourn the workshop. The Workshop ended at 9:05 P.M.
