Regular Meeting-December 17, 2014

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, December 17, 2014 at 7:00 P. M. in the Court-Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present:        Mayor Ray S. Cordova
                     Trustee Patrick Garcia
                     Trustee Ronald Cooksey
                     Trustee John Ray Telles
                     Trustee Robert Sainz

Absent:         Village Attorney Jefferson Rhodes

Also in attendance was Village Clerk Dianna Brusuelas-Guilez and Grants Coordinator Richard Gutierrez.

At 7:04 P. M. Mayor Ray S. Cordova called the meeting to order asking that all rise and join him in the Pledge of Allegiance to the Flag and the Salute to the Flag of the State of New Mexico.

Item 1.            Consideration of Agenda and Consent Agenda

Trustee Robert Sainz moved to consider the agenda and the consent agenda, motion was seconded by Trustee Patrick Garcia.

Roll Call Vote:  Trustee Cooksey, aye.  Trustee Garcia, aye.  Trustee Saint, aye.  Trustee Telles, aye.  Motion carried with all members voting in the affirmative. 

Item 2.            Unscheduled Correspondence and Public Comments

Mr. Kirk Crawford thanked the Mayor and the Board for the paving and painting of the parking lot at the Tularosa Senior Center.

Trustee John Ray Telles asked for an update on fire hydrants.  Mayor Ray Cordova said Trustee Telles was referring to the repairs of some of the hydrants and told Trustee Telles that the yard was short staffed and he did not intended to hire until after the first of the year.  Trustee Patrick Garcia said he knew the Mayor intended to hire someone that is qualified in water but also hoped it would be someone who wants to advance.   Mayor Cordova said he  planned to screen applicants thoroughly.  Trustee Robert Sainz suggested  also hiring a second person who is willing to go to school and get certified in water. 

Item 3.            Information:  Retirement of Trinidad (Pate) Guilez, effective December 10, 2014
Mayor Ray S. Cordova said that Ray Ramos has come to him and said he would be able to handle both plants for the time being and appreciated that Mr. Ramos was willing to do that.

Item 4.            Information:  Ray S. Ramos attained his Level 4 Water Certification

Mayor Ray Cordova said Mr. Ray Ramos took it upon himself to get tested for a Level 4 in Water and would like to bring him up next month for a raise.  Trustee Patrick Garcia said he would think that Mr. Ramos would want to help train someone at the plants.  Mayor Cordova said Mr. Ramos is willing to work with the village to train people.

Item 5.            Approval of Resolution 2014-2015-14 authorizing the submission of a Colonial’s Infrastructure application to NMFA and authorizing Mayor Ray S. Cordova as Chief Executive Officer in all matters pertaining to the Village

Trustee Patrick Garcia moved to approve Resolution 2014-2015-14 authorizing the submission of a Colonia's Infrastructure application to NMFA and authorizing Mayor Ray S. Cordova as Chief Executive Officer in all matters pertaining to the Village. 

Trustee Ronald Cooksey seconded the motion.

Roll Call Vote:  Trustee Cooksey, aye.  Trustee Garcia, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members voting aye.

Trustee Patrick Garcia thanked Rick Gutierrez for the Colonia's.

Item 6.            Monica Voorbach-Approval to award Irrigation Water Rights bid to the highest bidder

Trustee Patrick Garcia moved to approve awarding the Irrigation Water Rights bid to the highest bidder.

Trustee John Ray Telles seconded the motion.

Roll Call Vote:  Trustee Cooksey, aye.  Trustee Garcia, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members voting aye.

Item 7.            Approval of the Solid Waste Disposal Agreement between Otero County and the Village of Tularosa

Trustee Ronald Cooksey asked if the village was allowed to dump two loads a day.  Dianna Brusuelas-Guilez said yes we are allowed two dumps, sometimes we have two trucks running.

Trustee Robert Sainz moved to approve the Solid Waste Agreement between the Village of Tularosa and Otero County.

Trustee Ronald Cooksey seconded the motion asking how long does it take to do two runs.  Village Clerk Dianna Brusuelas-Guilez responded that he would have to ask Mike.

Trustee John Ray Telles asked about leasing a Solid Waste truck rather than purchasing another one.

Roll Call Vote:  Trustee Cooksey, aye.  Trustee Garcia, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members voting aye.

Item 8.            Consider for Adoption Ordinance 250 amending sections 95.03, 95.30, 95.31, 95.33 and 95.34 providing for the regulations of animals with exceptions, impoundment, investigation and enforcement relating to Chapter 95

Trustee Patrick Garcia moved to approve the adoption  of Ordinance 250.

Trustee John Ray Telles seconded the motion

Roll Call Vote:  Trustee Cooksey, aye.  Trustee Garcia, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members voting aye.

Item 9.            To publish Ordinance 250 by Title & Subject Matter

Trustee Patrick Garcia moved to publish Ordinance 250 by Title & Subject Matter, motion was seconded by Trustee Ronald Cooksey.

Roll Call Vote:  Trustee Cooksey, aye.  Trustee Garcia, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members voting aye.

Item 10.          15' easement for irrigation system requested by Tularosa Ditch Corporation, who will provide the easement drawing for record and who will pay for them

Trustee Patrick Garcia recalled when Norval Bookout came before the board asking for the easement and said all they would need from the village was permission and that they would bring a schematic so the village could see where the easement was going to run.

Trustee Patrick moved to approve the 15' easement as long as the Tularosa Ditch Corporation provides a drawing as to where the easement will be and pay for the paperwork for the record.

Trustee Robert Sainz seconded the motion.

Roll Call Vote:  Trustee Cooksey, aye.  Trustee Garcia, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members voting aye.

Item 11.          Approval of Temporary Employment Agreement with Susan Flores from January 1, 2015 thru June 30, 2015 at $11.00 per hour as per Chapter II, Section 20.01, Paragraph E of the Village of Tularosa

Trustee Robert Sainz moved and Trustee Patrick Garcia seconded the motion.

Trustee Ronald Cooksey said he felt the money could be used in other areas within the city.

Roll Call Vote:  Trustee Cooksey, nay.  Trustee Garcia, Nay.  Trustee Sainz, nay.  Trustee Telles, nay.   With all members of the Board voting nay, Mayor Cordova announced that the Temporary Employment Agreement will cease.

Item 12.          Trustee Ronald Cooksey-Discuss annexing property Northeast of village limits up to the water tanks and other properties

Trustee Ronald Cooksey said he would like the 2nd Main Fire station to be located within the Village Limits but did not know what the procedure is.

Rick Gutierrez said he would get with Branden Langley from Alamotero Land Surveying and then bring a map for approval  and start the process.

Item 13.          Old Business

Trustee Patrick Garcia wanted to ask the Chief how they were doing on the dog food situation.  Chief Wood said at the moment there were no concerns but when the new facility opens they will possibly house more dogs.  Trustee Garcia felt that the Chief should not be using his own funds to pay for food for the animals being housed at the pound.

Trustee Patrick Garcia asked Chief Wood  if there was training for the officers on issues of  entrapment and wondered what had transpired since the last complaint.  Trustee Garcia also had an additional letter that was given to him citing the same issue.

Chief Wood informed Trustee Garcia that he did not know which complaint he had but the ones he has in his office have been investigated.  Chief Wood said he has conferred with the District Attorney about improper stops and they were in agreement with the officers.  Chief Wood said though he has disciplined some officers the communication is favorable and officers are conducting themselves appropriately.  Chief Wood asked Trustee Garcia for a copy of the letter of complaint he has and he will review.

Mayor Ray Cordova asked the Chief if the officers were using the cameras.  Chief Wood responded yes.

Trustee Ronald Cooksey said he listens to the police radio and officers stay busy and thanked the Police Chief.

 Item 14.          New Business

Trustee Robert Sainz requested to refer back to item 11 and requested a special meeting before the end of the year to discuss where the funds could be used.

Mayor Ray Cordova said that he and the Clerk have discussed holding on to every nickle the village has because he feels the village is in for hard times because of the oil, and mentioned that this is one reason he has not filled the vacancy’s in the field and won't until after the first of the year.  Mayor Cordova said there was also discussion on cutting back on personnel.

Trustee Robert Sainz also asked for an audit of everything purchased by Keep Tularosa Beautiful to see if the village has everything in their possession or maybe the staff can make a list of everything purchased.  Mayor Cordova said maybe Santa Fe can come do that.

Village Clerk Dianna Brusuelas-Guilez said possibly a list could be generated in her office listing all purchases.

David Shields from Bohannon-Huston updated the Mayor and the Board on village projects stating that NMED had questions and he has addressed those comments.

The Water Distribution Project has been awarded and a pre-construction conference will be held, they will be utilizing the 2012 Colonias Grant.

The 2013 Colonias money will be used for the Water Treatment Plant project.

They have started breaking ground, clearing and prepping for the 2nd Main Fire Station and will continue after the holidays.

Mr. Shields said he met with the Water Trust Board and last year there was around 60 million dollars this year there is around 30 million  and 128 applicants.

Trustee Ronald Cooksey said he visited the Alamogordo Sewer Plant and they have a small computer that reads everything about the plant and wondered if we have that.  Mr. David Shields said no, not at the sewer plant but they are trying to build and repair some of the scada system into the villages water plant.

Village Clerk Dianna Brusuelas-Guilez asked if the computer at the Water Plant would be updated.  Mr. Shields said with the modifications a new computer would be installed and updated.

Trustee Robert Sainz said he watched on television an interesting program having to do with Trinity Site and featured several local people, Tina Cordova, Rosemary Cordova and the Garwoods, the program itself was very informative and the government is now initiating an investigation.

Mayor Ray Cordova informed the board that Dr. Kubota from Japan had come to visit with him for about two hours.  The Dr. is also conducting a study and says there is a lot of cancer in Japan also.

Item 15.          Adjourn

Trustee Ronald Cooksey moved to adjourn with a second by Trustee Patrick Garcia.

The meeting adjourned at 8:15  P. M.
