Regular Meeting – December 21, 2016

 

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, December 21, 2016 at 7:00 P. M. in the Court Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present:

Trustee Patrick A. Garcia
Trustee Robert L. Sainz
Trustee John 'Ray' Telles
Trustee Deanna M. Montoya

Also present was Dianna Brusuelas-Guilez Village Clerk as well as Village Attorney Jefferson Rhodes.

At 7:00 P. M. Mayor Ray S. Cordova called the meeting to order asking that all rise and join him in the Pledge of Allegiance and the Salute to the Flag of the State of New Mexico.

Consideration of Agenda and Consent Agenda

Trustee Robert Sainz moved to consider the Agenda and the Consent Agenda.  Trustee Patrick Garcia seconded the motion.

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

Unscheduled Correspondence and Public Comments

Trustee Patrick Garcia extended his sincere gratitude to the Police Department for solving the break in at the Tularosa High School. 

Trustee Patrick Garcia also mentioned looking for money for raises right after the holidays.  Mayor Ray Cordova mentioned increasing the water, sewer and garbage each by $2.00.  Village Attorney Jeff Rhodes was asked to draw up a draft ordinance increasing the utilities.

Village Clerk Dianna Brusuelas-Guilez mentioned that both Nash Kowatch and Richard Guilez would be attending a Wastewater school in January in Las Cruces.

3.      Information:  Federal district court in Texas granted an emergency injunction preventing the US DOL's new rule from taking effect. Item 5 from the November 2016 agenda has been recinded

Mayor Ray Cordova explained that the rule from Department of Labor raising all salaried employees to $47,476.00 has had an injunction filed and has been rescinded until further notice.

4.      Approval of Solid Waste Disposal Agreement between Otero County and the Village of Tularosa

Trustee Patrick Garcia moved to approve the agreement  between the Village of Tularosa and Otero County for Solid Waste.  Trustee John 'Ray' Telles seconded the motion.

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

 5.      Maria Farrias - HELP NM   ChiSPA – STEM

Ms. Maria Farrias was not present.  Trustee John 'Ray' Telles moved to table.  Trustee Patrick Garcia seconded the motion.  It was explained that if the Board wanted to bring it up at the next meeting it should be postponed.  Trustee Patrick Garcia moved to amend the motion and moved to postpone the issue until the next regular meeting.  Trustee Deanna Montoya seconded the motion.

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

 6.      Jennifer Gruger-Tularosa Arts & History Council Update:  Printed brochure and 2017 events

Ms. Jennifer Gruger gave the Mayor and members of the Board an update on the Tularosa Arts and History Council and mentioned several events that the council will be planning in 2017.  Trustee Deanna Montoya agreed to be the liaison between the village and TAHC and Trustee Patrick Garcia agreed to work with TAHC with the schools and the luminaria project for next year.

7.      Approval of Mary Miller - Certified Dispatcher as a Probationary Employee at $10.45 per hour with 6 months probation

Trustee Robert Sainz moved to approve Mary Miller as a Certified Dispatcher on a probationary status with 6 months probation at $10.45 per hour.  Trustee Deanna Montoya seconded the motion.

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

8.      Approval of Mark Christensen-Certified Police Officer as a Probationary Employee at $16.50 per hour with 6 months probation

Trustee Patrick Garcia moved to approve Mark Christensen as a Certified Police Officer on a 6 months probationary status at $16.50 per hour.  Trustee Robert Sainz seconded the motion.

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

 9.      Approval of Alex Medina-Solid Waste Technician-From probationary employee to a Regular Full Time employee, from $13.00 to $13.50 effective 12/22/2016

Trustee Patrick Garcia moved to postpone until the January meeting.  Trustee John 'Ray' Telles seconded the motion. 

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

10.    Approval of Temporary Employment Agreement with Alex Duran from December 2016 – February 2017 at $8.00 per hour as per Chapter II, Section 20.01, Paragraph E, of the Village of Tularosa Personnel Policy

Trustee Patrick Garcia moved to approve the Temporary Employment Agreement with Alex Duran from December 2016 to February 2017 as per Chapter II, Section 20.01, Paragraph E, of the Village of Tularosa Personnel Policy.  Trustee Deanna Montoya seconded the motion.

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

 11.    Dianna Brusuelas-Guilez-Request to pay invoices as they come in. Auditors finding 2015-003 Late Payments

Village Clerk Dianna Brusuelas-Guilez explained that with a previous administration the village bills could not be paid until the bills list was brought to the Board meeting and approved, by that time some of the invoices are past 30 days.  Ms. Brusuelas-Guilez feels that invoices need to be paid immediately because some vendors are charging late fees and it then becomes an audit finding.  Ms. Brusuelas-Guilez said the board would still receive a bills list every month and if they have questions they can question the department head where the expenditure occurred.

Trustee Patrick Garcia said if the expense is already made how can the Board not approve.  Discussion ensued about having someone do an inventory.

Trustee Robert Sainz moved to approve paying the invoices as they come in.  Trustee Patrick Garcia seconded the motion.

Roll Call Vote:  Trustee Garcia, aye.  Trustee Montoya, aye.  Trustee Sainz, aye.  Trustee Telles, aye.  Motion carried with all members of the board voting aye.

 12.    Old Business

Trustee John 'Ray' Telles asked if the trailer on Marshall has been moved.  Response was no it's still there and a summons has been issued. 

Trustee Robert Sainz asked the Mayor if he has spoken to Susan about the building next to the Police Department, Mayor Cordovas response was that he left a message.

13.    New Business

Trustee Patrick Garcia asked about the Youth Basketball Program wondering who is going to run it.  Both Mayor Ray Cordova and Patrick Garcia said they would visit with Sonya Gililland to see if she will run it or has any idea who will take it this year.

14.    Adjourn

Trustee Robert Sainz moved to adjourn with a second from Trustee John 'Ray' Telles.  The meeting adjourned at 7:57 P.M.
