Regular Meeting-February 13, 2013

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, February 13, 2013 at 7:00 P. M. in the Court Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, NM.

Present: Mayor Ray S. Cordova
Trustee Patrick Garcia
Trustee Gloria R. Sainz
Trustee Fred O. Tyler

Absent: Trustee Joseph Lueras

Also present was Village Clerk Dianna Brusuelas-Guilez, Village Attorney Jefferson Rhodes and Rick Gutierrez Grants Coordinator.

Mayor Cordova called the meeting to order and asked everyone to join him in the Pledge of Allegiance and the Salute to the Flag of the State of New Mexico.

Item 1. Consideration of Agenda and Consent Agenda

Trustee Fred Tyler moved to consider the agenda and consent agenda. Trustee Patrick Garcia seconded the motion.

Roll Call Vote: Trustee Garcia, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members present voting aye.

Item 2. Unscheduled Correspondence and Public Comments

Trustee Patrick Garcia has some comments on Solid Waste and wondered if the village was going to go the extra mile and pick up the extra bagged trash that does not fit in the cart. Village Clerk Dianna Brusuelas-Guilez said she thought the idea was for the Solid Waste workers not to get out of the truck. Mike Gaston and Pat Wooten had both come to the office with the concern and said there were just a few customer who had extra trash every week but who did not warrant an extra trash can. Village Clerk Brusuelas-Guilez suggested trying to buy a few larger carts maybe 105 or 110 gallon size for the customers in question and charging an extra dollar or two instead of giving the customer another 95 gallon cart and charging another full price. For the time being Trustee Patrick Garcia said he would appreciate the courtesy.

Trustee Fred Tyler thanked all the department heads who turned in their monthly reports.

Next to make a presentation was Jerry Martinez who said they were in the process of doing a Centennial Celebration of the Chiricahua Apache Freedom. The Chiricahus were freed April 6, 1913 and brought to Tularosa by train to an adobe train depot on West First and Railroad which is where they want to start the celebration. Mr. Martinez' request was to be allowed to do a walk by original ancestors of Chiricahus tribe, to the Mescalero Reservation, it will be a two day blessing feast and also requested police protection for the wagons. He has been in contact with the Bureau of Indian Affairs and the Sheriffs Department who will also provide protection. Mr. Martinez said he would get on the agenda for the March meeting to ask for the the police escort. Attorney Jeff Rhodes told Mr. Martinez he possibly knew how to get a picture of the old train depot and also referred him to Mr. McDonald. The celebration will be April 5th and 6th. Mr. Martinez invited all the Board Members and the Mayor to participate.

Item 3. David B. Sanchez-To replace 4" clay sewer line on Hagee Lane

There was no action taken until Rick Gutierrez goes to the county courthouse to get a plat map and a price on the cost.

Item 4. Valli Kinder-Permission to place RV at 1003 Montezuma-request utilities per Village of Tularosa

Trustee Patrick Garcia moved to approve and was seconded by Trustee Gloria Sainz. Trustee Fred Tyler said he read the Zoning Ordinance and Ms. Kinder would have to keep it as a temporary unit to be in compliance.

Village Clerk Dianna Brusuelas-Guilez asked if they would be putting all utilities, the response was yes.

Item 5. Dianna Brusuelas-Guilez-Consider for Adoption Ordinance 245 amending Section 154.22(B) prohibiting certain activities in the (HC) Historical Commercial zoned areas and to Publish by Title and Subject
Matter

Trustee Fred Tyler asked if the ordinance meant that they would pull in their wares in the evening. Mr. Rhodes said yes. Trustee Patrick Garcia said but during daylight hours things would be on display and still look unsightly. Mr. Rhodes said this was a reasonable ordinance. Mayor Cordova said he did not want to discourage business and a lot of places display wares which are not to cumbersome. Mr. Rhodes said he would include other then motor vehicles or trailers.

Trustee Fred Tyler moved to approve the consideration for Adoption of Ordinance 245 and was seconded by Trustee Patrick Garcia.

Item 6. Dianna Brusuelas-Guilez-Consider for Adoption Ordinance 246 providing for Penalty Assessments and providing for penalties for certain offenses to be increased and to Publish by Title and Subject Matter

Trustee Fred Tyler moved to approve the consideration for adoption of Ordinance 246 and was seconded by Trustee Patrick Garcia.

Trustee Patrick Garcia wanted to add double fines for passing in school zones. Chief Chuck Wood also asked to include construction zones in the double fines.

Roll Call Vote: Trustee Garcia, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members present voting aye.

Item 7. Rick Gutierrez-Approval of Resolution 2012-2013-11 submitting an application to the New Mexico Department of Transportation's Municipal Arterial Program (MAP)

Trustee Patrick Garcia moved to approve. The motion was seconded by Trustee Gloria Sainz.
Roll Call Vote: Trustee Garcia, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members present voting aye.

Item 8. Valarie Delgado-Approval of Resolution 2012-2013-12 Budget Increases and Decreases

Trustee Gloria Sainz moved to approve Resolution 201202013-12 Budget Increases and Decreases. Trustee Fred Tyler seconded the motion.

Roll Call Vote: Trustee Garcia, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members present voting aye.

Item 9. Dianna Brusuelas-Guilez-Approval of 2011-2012 Fiscal Year Audit Report as per Section 2.2.210(J)(3)(d) NMAC

Trustee Patrick Garcia asked if this audit was the one done by Ms. Willoughby. Village Clerk Dianna Brusuelas-Guilez responded yes.

Trustee Patrick Garcia then moved to approve, motion was seconded by Trustee Gloria Sainz.

Item 10. Dianna Brusuelas-Guilez-Approval of Municipal Motor Vehicle Service Provider Agreement with the State of NM Taxation and Revenue Department

Trustee Patrick Garcia moved to approve the Municipal Motor Vehicle Service Provider Agreement. Trustee Fred Tyler seconded the motion.

Trustee Fred Tyler asked if this was costing us any money. The Village Clerk responded no.

Item 11. Old Business

Trustee Patrick Garcia mentioned that he recently saw a lot of people using the handball courts. Mayor Cordova asked if the net was in place. Trustee Garcia said Sonya was in the process of ordering it.

Item 12. New Business

Mayor Cordova wanted to mention that he and the Board were approached at the Workshop by an individual complaining about the Recreation Basketball Program, that the goals were set to high for the 5 and 6 year olds. The Mayor said hearing the complainants side of the story, it seemed that our Recreation Director has gotten nasty with her. Mayor Cordova said both he and Trustee Garcia talked to the Director and learned a very different story including that there were some
profanity's used by the complainant and her husband. Trustee Fred Tyler said a lot of the spectators were concerned. Mayor Cordova said the lady said the Alamogordo Recreation goals were set at 6 feet. The Tularosa Recreation Director got a copy of the Alamogordo rules and gave a copy to the Mayor and the Board and verified that their goals are set at 7 feet not 6. Mayor Cordova said he just wanted the board to know that they should back the Recreation Director and has asked the Chief of Police to patrol the games and make their appearance inside the games.

Trustee Fred Tyler moved to adjourn. The meeting ended at 7:55 P. M.
