Regular Meeting-June 16, 2010

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, June 16, 2010 at 7:00 P. M. in the Court/Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present: Mayor Ray S. Cordova

Trustee Patrick Garcia

Trustee Joseph Lueras

Trustee Gloria Sainz

Trustee Fred Tyler

Also in attendance was Village Attorney Jeff Rhodes, Grants Coordinator Richard Gutierrez, Payroll A/P Clerk Monica Voorbach, as well as the Village Clerk-Treasurer Dianna Brusuelas-Guilez.

Mayor Ray S. Cordova called the meeting to order and asked that all rise and join him in the Pledge of Allegiance.

Item 1. Consideration of Agenda and Consent Agenda

Trustee Gloria Sainz moved to consider the Agenda and the Consent Agenda. Motion was seconded by Trustee Joseph Lueras.

Roll Call Vote: Trustee Tyler, aye. Trustee Lueras, aye. Trustee Garcia, aye.

Trustee Sainz, aye. Motion carried with all members of the board voting aye.

Item 2. Unscheduled Correspondence and Public Comments

A member of the audience, Johnny Vallejos voiced concerns on the highway median project stating that his group does not oppose the widening of the highway but opposed the taking away of the parking spaces in front of the Catholic Church. Mr. Vallejos wondered if there were other alternatives such as installing signal lights and requested another public hearing.

Mayor Ray S. Cordova introduced Bob Kurtz from the State Highway Department with the District Office out of Roswell. Mr. Kurtz explained that he has been working with the village for numerous years on how to calm the traffic on highway 54/70 and after a study they felt that medians would slow down the traffic. Mr. Kurtz said they would put ADA compliant ramps and redo the sidewalks. After much discussion some suggestions were to consider the danger with the highway closer the church, enforcement of speeders by the police department, installing a pedestrian crossing light and narrowing the medians.

There were questions about the historic district. In conclusion Mr. Kurtz said he would take concerns to the District Office. Mayor Ray Cordova stated that the median project was strictly a safety issue and the refuge islands would be for people to cross halfway and then continue on.

Trustee Joseph Lueras wanted to thank Susan Flores for the grants she has received.

Trustee Patrick Garcia also wanted to thank all the village employees for the work they do saying that so often they are overlooked.

Trustee Fred Tyler mentioned the weeds at the yard stating he received a complaint.

Trustee Gloria Sainz asked whose responsibility it was for the weeds along the highway. Mayor Cordova's response was that some of it was the villages.

Item 3. Safety Coordinator, Dana Lopez-Approval of the Village of Tularosa Emergency Action Plan and the Safety Health Program

Trustee Gloria Sainz moved to approve the Village of Tularosa Emergency Action Plan and the Safety Health Program as presented. Motion was seconded by Trustee Joseph Lueras.

Roll Call Vote: Trustee Tyler, aye. Trustee Lueras, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members of the board voting aye.

Item 4. Finance Officer, Valarie Delgado-Adoption of Resolution 2009-10-18 Increase budgets for OAP, Library, Capital Projects and General Fund

Trustee Fred Tyler moved to approve the adoption of Resolution 2009-10-18 Increase budgets for OAP, Library, Capital Projects and General Fund. Trustee Joseph Lueras seconded the motion.

Roll Call Vote: Trustee Tyler, aye. Trustee Lueras, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members of the board voting aye.

Item 5. LANCON-802 Elouise Circle-Approve Building Site Permit-New Construction

Mayor Cordova announced that he had approved the Site Permit since there was no variance request.

Item 6. Monica Voorbach-Award contract for Random Drug Screening

Trustee Gloria Sainz moved to award the contract to BEH and was seconded by Trustee Joseph Lueras.

Item 7. Mayor Ray Cordova-Approve Temporary Employment Agreement with Susan Flores, from July 1, 2010 through September 30, 2010 as per Chapter II, Section 20.01, paragraph E, of the Village of Tularosa Personnel Policy with no more than 20 hours a week at $10.00 per hour

Trustee Fred Tyler moved to approve the Temporary Employment Agreement with Susan Flores, from July 01, 2010 through September 30, 2010 as per Chapter II, Section 20.01, paragraph E, of the Village of Tularosa Personnel Policy with no more than 20 hours a week at $10.00 per hour with the added stipulation to have a monthly account of hours spent and criminals time used. The motion was seconded by Trustee Joseph Lueras.

Trustee Patrick Garcia asked Mayor Cordova about relocating Susan's office. Mayor Cordova's response was no relocation had been done since it is a temporary position he has not looked at it.

Item 8. Mayor Ray Cordova-Approve Temporary Employment Agreement with Joshua Puckett, from July 1, 2010 through September 30, 2010 as per Chapter II, Section 20.01, paragraph E, of the Village of Tularosa Personnel Policy with no more than 20 hours a week at $7.50 per hour

Trustee Patrick Garcia asked where this pay was coming from. Mayor Ray S. Cordova responded that it was currently coming from the Utility Fund, the area where the previous temporary was being paid from but that after July the pay would come from the Community Center in the General Fund.

Trustee Fred Tyler asked Village Attorney Jeff Rhodes if Josh could be in two categories of employment. Mr. Rhodes said he did not see why not., the only question that might arise is at what rate of pay would overtime be paid.

Trustee Fred Tyler moved to approve Temporary Employment Agreement with Joshua Puckett, from July 01,2010 through September 30, 2010 as per Chapter II, Section 20.01, Paragraph E of the Village of Tularosa Personnel Policy with no more than 20 hours a week at $7.50 per hour. Motion was seconded by Trustee Gloria Sainz.

Item 9. Chief Ken Selman-Request to promote Officer Chuck Wood to the position of Patrol Sergeant and increase pay to $15.50 per hour effective with the July 1, 2010 budget

Trustee Joseph Lueras moved to approve the request to promote Officer Chuck Wood to the position of Patrol Sergeant and increase oat ti $15.50 per hour effective with the July 1, 2010 Budget. Trustee Fred Tyler seconded the motion.

Trustee Fred Tyler asked if the increase was in the budget. The response was that it was put into the new budget.

Item 10. Chief Ken Selman-Request confirmation of Officer Jessica Turner to Full Time Regular Employee, completed 6 month probation period successfully, date of hire 08/24/2009. Requesting pay from Non-Certified pay of $10.00 to $12.50 Certified Officer, as per Section 80.01 Village Personnel Policy Pay Scale. Graduated from Southern New Mexico Law Enforcement Academy on 06/08/2010

Trustee Gloria Sainz asked if Ms. Turner has received her certification number from the academy in Santa Fe. Village Clerk Dianna Brusuelas-Guilez responded that she has in her office a certificate that Jessica Turner has completed Basic Police Officer Training Academy consisting of 883 hours but does not have the certification number that Santa Fe sends out.

Trustee Gloria Sainz moved to confirm Officer Jessica Turner to Full Time Regular employee, completed 6 months probation period successfully and upon receiving her certification number move her pay from $10.00 to $12.50 as per Section 80.01 Village Personnel Pay scale policy. Trustee Joseph Lueras seconded the motion.

Item 11. Trustee Fred Tyler-Requesting Village co-sponsor a Candle Light Ceremony on July 16, 2010 and Educational and Film Documentary opportunities on July 17, 2010 in support of TBDC and Tularosa citizens

Trustee Fred Tyler gave a history of the Tularosa Basin Downwinders Consortium explaining that they helped push for a resolution to include New Mexico in the Radiation Exposure Compensation Act and requested that the village co-sponsor a candle light ceremony on the 16th of July which is the 65th anniversary of Trinity Site. Trustee Tylers request was to allow the use of the Little League Baseball field and Community Center.

Trustee Joseph Lueras moved for the village to co-sponsor the candle light ceremony on July 16, 2010 and educational and film documentary opportunities on July 17, 2010 in support of TBDC and Tularosa citizens. Trustee Gloria Sainz seconded the motion.

Item 12. Old Business

Trustee Fred Tyler asked about the Rhino Subdivision water rights. Attorney Jeff Rhodes said he would talk to Klad Zimmerle about them noting that they were both working on a contract.

Trustee Joseph Lueras asked about the auction on the vehicles. Mayor Cordova responded that there would be an auction this summer.

Trustee Fred Tyler stated that someone should start to clean the exterior of the yard. Mayor Cordova asked the clerk to prepare a workorder.

Item 13. New Business

Trustee Patrick Garcia wanted to let everyone know that the weeds along the highway would soon be cleaned up.

Mayor Ray Cordova announced that he had met with the contractor and architect on the Senior Center building and everything was going well.

Item 14. Adjourn

Mayor Cordova entertained a motion to adjourn.

Trustee Gloria Sainz moved to adjourn and Trustee Joseph Lueras seconded the motion. There being no further business to come before the board the meeting adjourned at 8:20 P. M.
