Regular Meeting-March 20, 2013

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, March 20, 2013 at 7:00 P. M. in the Court Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, NM.

Present: Mayor Ray S. Cordova
Trustee Patrick Garcia
Trustee Gloria R. Sainz
Trustee Fred O. Tyler
Trustee Joseph Lueras

Absent: Attorney Jefferson Rhodes

Also present was Village Clerk Dianna Brusuelas-Guilez, Rick Gutierrez Grants Coordinator and Monica Voorbach PR/AP Clerk.

Mayor Cordova called the meeting to order and asked everyone to join him in the Pledge of Allegiance and the Salute to the Flag of the State of New Mexico.

Item 1. Consideration of Agenda and Consent Agenda

Trustee Gloria Sainz asked to remove item 8 from the agenda.

Trustee Patrick Garcia moved to consider the agenda and the consent agenda with a second by Trustee Joseph Lueras.

Roll Call Vote: Trustee Garcia, aye. Trustee Lueras, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members voting in the affirmative.

Item 2. Unscheduled Correspondence and Public Comments

Susan Flores, Keep Tularosa Beautiful Director brought up her advisory council to present awards received for 2012. Ms. Flores made mention that she has just applied for a $23,125.00 grant from Lowe's and is hoping to use it for landscaping at the Tularosa Senior Center to put fencing around the courtyard, artificial grass by the two end caps, shade trees on the east side and shrubs in the front.

Mr. Kirk Crawford mentioned to the board that at the Recycling Center on Highway 70 is a huge hole and requested repairs. Mayor Ray Cordova asked the Village Clerk to make a note to send the crew to repair.

Trustee Patrick Garcia asked Mr. Rick Gutierrez if anything had transpired on the request by David Sanchez on the sewer line on Hagee Lane. Mr. Rick Gutierrez said he spoke with Steve from the county and there would have to be a title search the Rocha's and the Sanchez' were informed but neither have taken the initiative to proceed.

Item 3. Ruth Birdsong-Salvage Rights to old Museum Building at 608 Hwy 70 to purchase salvage rights for $1.00 (wood flooring, walls & light fixtures)

Ms. Birdsong was informed that the village would have to go out to bid and at that time she can bid for it.

Item 4. Ruth Birdsong-Approval of "Treasure Round-Up" Fund raiser for museum on May 11, 2013 on village property

Ms. Birdsong was asked how many spaces there would be. Ms. Birdsong replied that there would be 30 8x8 spaces at $15.00 per space.

Trustee Fred Tyler moved to grant approval for the Treasure Round-Up fund raiser for the museum on May 11, 2013. Motion was seconded by Trustee Joseph Lueras.

Item 5. Chiricahua Commemoration Committee-Lynette Kanseah, Debra Martinez-Requesting support from village and providing police escort within village limits, approve beginning Walk-Run from W. 1st & Railroad

Debra Martinez, Co-Chair of the Chiricahua Committee, introduced the committee members and shared information about the centennial celebration that will be held April 5th and 6th. One of the events will be to reenact when their Apache people were released from Ft. Sill, Oklahoma and arrived in Tularosa on the train and were taken to Mescalero on buckboard wagons, horseback and some walked. The reenactment will begin on West 1st Street and Railroad Avenue where the old train depot was. Ms. Martinez asked for approval to do the reenactment through Tularosa and asked for police escort up to the city limits. Mr. Charles Gonzales representing the Otero County Sheriffs office shared information saying they were going to have three officers on horseback who would be assisting with the escorting, they will also use electrical billboards. Ms. Martinez extended the invitation to the Mayor, Trustees and village members.
Trustee Fred Tyler then made a motion to support the Chiricahua Commemoration Committee and provide police escort. Trustee Joseph Lueras seconded the motion.

Item 6. Rick Gutierrez-Approval of Resolution 2012-2013-09 Authorizing the submission of a 2013 Colonias Infrastructure Application

Trustee Patrick Garcia moved to approve and was seconded by Trustee Fred Tyler.

Item 7. Dianna Brusuelas-Guilez-Approval of Resolution 2012-2013-10 Open Meetings Act Resolution

Trustee Patrick Garcia moved to approve Resolution 2012-2013-10 and was seconded by Trustee Joseph Lueras.

Item 8. Prestina Jenkins-Approval of Tularosa Senior Center Policies and Procedures

Item deleted.

Item 9. Friends of Historic Tularosa (1) Discuss Memorial Observance Day, May 27, 2013 (2) Status of Capital Outlay funding for Memorial Park (3) Does Village have insurance on gazebo canvas being torn

Cynthia Prelo-Riedlinger chair person for Friends of Historic Tularosa said they were in the process of having the Memorial Day Observance May 27th at 11:30. Ms. Prelo-Riedlinger asked what the status of the capital outlay funding for the veterans park was. Mr. Rick Gutierrez said the village received funding for the Animal Control and that only the first five items were considered and the Veterans Park was listed as number 12 on the ICIP list. The vandalism on the gazebo cover was mentioned. Mayor Cordova asked Ms. Prelo-Riedlinger for an estimate and a copy of the police report to turn into the insurance. They would like to replace it with metal roofing.

Item 10. Trustee Fred Tyler-Change Section 80.01 of the Personnel Policy salary ranges

Mayor Ray Cordova explained that a lot more work needed to go into section 80.01 but at this time we are only adjusting the maximum caps on the wages to coincide with the increases given to the employees. Village Clerk Dianna Brusuelas-Guilez said the only change was on page two in the Public Safety area where Chief Chuck Wood asked for the minimum caps be changed to what is highlighted in green.

Trustee Fred Tyler made a motion to approve the changes to Section 80.01 of the Personnel Policy in reference to the salary caps and the police department scale.
Trustee Patrick Garcia seconded the motion.

Item 11. Dianna Brusuelas-Guilez-Request to have village attorney prepare ordinance to increase the basic water service charge, the basic sewer charge and the basic solid waste collection charge for residential inside village limits by $1.50 each, to be effective in the July billing cycle

Trustee Patrick Garcia moved to approve and was seconded by Trustee Joseph Lueras.

Item 12. Mayor Ray Cordova-Approval of Temporary Employment Agreement with Susan Flores from April 2, 2013 to June 30, 2013 with no more than 20 hours per week at $11.00 per hour as per Chapter II, Section 20.01, Paragraph E, of the Village of Tularosa Employee Personnel Policy

Trustee Joseph Lueras made a motion to approve item 12, Trustee Gloria Sainz seconded Trustees Lueras motion.

Roll Call Vote: Trustee Garcia, nay. Trustee Lueras, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with three ayes and one nay.

Item 13. Mayor Ray Cordova-Approval of Temporary Employment Agreement with Pat Wooten from April 2, 2013 to June 30, 2013 with no more than 20 hours per week at 10.75 per hour as per Chapter II, Section 20.01, Paragraph E, of the Village of Tularosa Employee Personnel Policy

Trustee Gloria Sainz moved to approve. Trustee Joseph Lueras seconded the motion.

Trustee Patrick Garcia asked if the split hours were straightened out. Mayor Cordova replied that the hours were split 20 and 20. Trustee Garcia said his concern was if the village had a full-time driver for Solid Waste why did we need to split the hours 20 and 20 and wondered what the full-time driver was doing while the part-time driver was driving 20 of the hours and felt Wooten could be used in other areas of the village and just used as a backup driver for Solid Waste. Village Clerk Dianna Brusuelas-Guilez suggested that now that summer was here have Patrick Wooten work more with Ralph and take care of the parks and have Mike take care of the Solid Waste. Trustee Patrick Garcia said that when the Solid Waste was started the big concern was having a back-up driver and the village needs someone to take care of all the parks and the little league field. Trustee Garcia feels Mike can run the Solid Waste unless he is on vacation or sick, in those instances have Patrick fill in. Mayor Cordova said he would devote more time for Patrick to do the parks. Trustee Garcia just feels we could do better there.

Trustee Fred Tyler mentioned that the Shriners are intending to do the Rose Festival in Tularosa on the 1st of June.

Trustee Joseph Lueras brought up the Tularosa High School Art Expo sponsored by the Tularosa Rotary Club.

Mayor Ray Cordova was very happy to announce that Tularosa Basin Telephone Company has given to the village as a gift a cherry picker. Mayor Cordova said he went and looked at it and it is in excellent shape, is being maintained on a regular and that the title has been signed over. Tularosa Basin Telephone Company will also train our employees. A round of applause ensued.

Susan Flores mentioned that a Spring Clean Up was in the works for April 13th through the 28th.

Trustee Patrick Garcia asked about the vehicle the police department was going to give the village. Mayor Cordova said the stripping and the cage have to be removed.

Trustee Joseph Lueras moved to adjourn.

There being no further business to come before the board the meeting adjourned at 8:10 P. M.
