Regular Meeting-March 19, 2014

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular meeting on Wednesday, March 19, 2014 at 7:00 P. M. in the Court/Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present: Mayor Ray S. Cordova
Trustee Patrick Garcia
Trustee Ronald Cooksey

Absent: Trustee John 'Ray' Telles

Also present was Grants Coordinator Richard Gutierrez, Village Clerk Dianna Brusuelas-Guilez as well as Village Attorney Jefferson Rhodes.

At 7:00 P. M. Mayor Ray S. Cordova called the meeting to order and asked that all rise and join him in the Pledge of Allegiance and the Salute to the Flag of the State of New Mexico.

1. Consideration of Agenda and Consent Agenda

Trustee Patrick Garcia moved to consider the agenda and the consent agenda. Motion was seconded by Trustee Ronald Cooksey.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Motion carried with all members present voting aye. Mayor Cordova stated that if he would have had to vote he would have voted in the affirmative.

2. Unscheduled Correspondence and Public Comments

Trustee Patrick Garcia thanked the Police Department and the Fire Department for escorting the girls 2A State Basketball Champ's home on their return from Albuquerque. The parade was at least one mile long and the Chief asked the County Sheriff's and the State Police for help in the village while the escorting the team in.

Trustee Patrick Garcia also wanted to squelch rumors about the incident on Gallegos Lane and asked the Chief what had occurred. Chief Charles Wood said that it was an electrical fire and there was also a sonic boom at the same time and people thought it was a meth lab explosion. Chief Wood also said they had Paul Quaroli the Otero County Emergency Services Director here and he agreed that it was an electrical fire and that the rumors were not true.

Ms. Rachael Thomas introduced herself and said she is starting a business called the Mini Paws Rescue but will place herself on the agenda for the next meeting and give the board more information.

3. Mayor Ray S. Cordova-Approval of appointment of Robert Sainz as Trustee to fill the position vacated by Trustee Fred Tyler

Mayor Ray Cordova introduced Robert Sainz stating that he is a life long resident of the village, he has served on the school board and announces at the football games for the schools. Mayor Cordova proceeded to ask the Board to consider him to fill the vacancy position left by Trustee Fred Tyler.

Trustee Patrick Garcia moved to approve the Mayor's appointment. The motion was seconded by Trustee Ronald Cooksey.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Motion carried with all members present voting aye.

Mr. Robert Sainz being in the audience was then sworn in by the Village Clerk Dianna Brusuelas-Guilez and took his seat on the council.

4. Ray S. Cordova-Confirmation of the names of persons to appointive offices, Charles Wood as Police Chief and Dianna Brusuelas-Guilez as Village Clerk and confirm names of employees as per attached list

Trustee Patrick Garcia moved to approve the appointive offices of Charles Wood as Police Chief, Dianna Brusuelas-Guilez as Village Clerk and to confirm the names of the employees as per attached list. Trustee Ronald Cooksey seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members present voting aye.

Mayor Cordova asked about swearing in Police Chief Wood and Village Clerk Dianna Brusuelas-Guilez. Ms. Brusuelas-Guilez said she would get Valarie Delgado to swear them in at the office.

5. Dianna Brusuelas-Guilez-Approval of Resolution 2013-2014-19 Open Meetings Act Resolution

Trustee Patrick Garcia moved to approve Resolution 2013-2014-19 Open Meetings Act Resolution. Trustee Ronald Cooksey seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members present voting aye.

6. Dianna Brusuelas-Guilez-Approval of Resolution 2013-2014-20 relating to the reimbursement of Public Officers and Employees for travel expenses and attending meetings

Trustee Patrick Garcia moved to approve Resolution 2013-2014-20 and was seconded by Trustee Ronald Cooksey.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members present voting aye.

7. Richard Gutierrez-Approval of Resolution 2013-2014-21 making application to the NM Highway & Transportation Department for the Co-Op Program

Trustee Patrick Garcia moved to approve Resolution 2013-2014-21 making application to the NM Highway & Transportation Department
for the Co-Op Program. Trustee Ronald Cooksey seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members present voting aye.

9. Tiffany A Koenig-Request to cut down tree

Mr. Tom Ross representing Tiffany Koenig asked to cut the tree down on Durazno & 8th Street claiming someone might get hurt. Ms. Koenig has had a vehicle accident there. It was suggested to move the Stop sign forward. Chief Charles Wood said the accident on that corner was a driver error and there are quite a few places that drivers have to be cautious.

Trustee Patrick Garcia moved to postpone this item until the April meeting and was seconded by Trustee Ronald Cooksey.

8. Richard Gutierrez-Approval of Resolution 2013-2014-22 making application to the NM Highway & Transportation Department for the (MAP) Municipal Arterial Program

(Item 9 was taken before item 8) Trustee Patrick Garcia moved to approve Resolution 2013-2014-22 making application to the NM Highway Transportation Department for the Municipal Arterial Program. Trustee Ronald Cooksey seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members present voting aye.

10. Ronald Cooksey-Request to stop all village vehicles from going home on personal business except for person on standby and 2 people to a vehicle instead of 1

Trustee Ronald Cooksey moved, and was seconded by Trustee Patrick Garcia.

The question was asked does it pertain to all village vehicles, the response was yes. Fire Chief John Montoya said that 3 drivers of his vehicles are Emergency Responders and are actually on call 24/7. It was stated that only Emergency Responders could keep their cars as long as Fire Chief Montoya monitors the vehicles and they are not being used for personal use. The Police Officers would also be excluded from the take home policy. It was questioned whether the yard personnel are supposed to park the trucks at lunch and it was stated that only the person on standby should have a vehicle. After much discussion it was said that the Department Heads could use their discretion.

11. New Business

David Shields from Bohannon-Huston gave the Mayor and Board an update stating that the property and fence issues were being worked out. Mr. Shields said that Monday's meeting was very productive, he met with representives from Robert's Filters and Ray Ramos the Villages Water Operator they are doing a pilot study, improving filters and the concept of moving the UV.

Mr. Shields has been working with Dora from the COG on the Colonias funding.

Mr. Shields said the village should start looking for property to acquire, by the treatment plant to drill a well and recommended Shoemaker and Associates since they know the basin.

Mr. Shields said the Water Trust Board will meet next month in Santa Fe.

Mr. Shields has the floor plan for the new Fire Station, still needs permits from the Environment Department and they will need to move the gate further East.

Mayor Ray Cordova thanked David for the reports and stated that he has the Board spoiled by coming every month with updates on projects.

12. Old Business

It was asked about a Proclamation for the Wildcat Girls winning the State Basketball Championship. Village Clerk Dianna Brusuelas-Guilez said she would prepare the Proclamation so it could be presented to the girls at their awards banquet proclaiming March 26th 2014 as "Lady Wildcat Day."

13. Adjourn

Trustee Ronald Cooksey moved to adjourn. Trustee Robert Sainz seconded the motion.

There being not further business to come before the Mayor and the Board the meeting adjourned at 7:50 P.M.
