Regular Meeting-May 21, 2014

The Mayor and the Board of Trustees of the village of Tularosa met in a Regular Meeting on Wednesday, May 18, 2014 at 7:00 PM in the Court Conference room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present: Mayor Ray S. Cordova
Trustee Patrick Garcia
Trustee Ronald Cooksey
Trustee John 'Ray' Telles
Trustee Robert Sainz

Also present was Grants Coordinator Richard Gutierrez, Village Clerk Dianna Brusuelas-Guilez as well as Jefferson Rhodes the Village Attorney.

At 7:00 P.M. Mayor Ray S. Cordova called the meeting to order asking that all rise and join him in the Pledge of Allegiance to the flag and the Salute to the flag of the State of New Mexico.

1. Consideration of agenda and consent agenda

Trustee Patrick moved to consider the Agenda and the Consent Agenda. Trustee Ronald Cooksey seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

2. Unscheduled correspondence and public comments

Susan Flores, Keep Tularosa Beautiful, gave an update on the landscaping at the Senior Center and showed the Board a couple of her awards.

3. Judge Angie Schneider-Presentation of programs-Otero Juvenile Justice Council

No Show

4. Alan Baker-Final update of Rose Festival, parade route, etc.

Mr. Alan Baker updated the Mayor and the Board on the final festivities of the Rose Festival asking the Mayor if he would be part of the parade Saturday at 10:00 A. M. Mayor Cordova advised that he would look at his calendar and let him know also telling Mr. Baker that maybe he could invite the Girls High School Basketball team to make a float since it was the first time in history that they have won the State Championship. Trustee Patrick Garcia also mentioned that the Girl's Cheer and Drill team also took state. It was agreed that the village would pay for the porta-potties for the event.

5. Jacob Parr-Variance on sign size. To increase sign size

Mr. Jacob Parr came before the village board to request a variance to place a business sign on his property on Bookout Road. Village ordinance says a sign can be placed not more than 8 inches in width and 36 inches in length, Mr. Parr's request was 18 inches wide and 24 inches high.

Trustee John 'Ray' Telles moved to approve the variance and was seconded by Trustee Ronald Cooksey.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

6. Approval of lease between Village of Tularosa and Gerald Marr

Mr. Gerald Marr said he has turned the property over to Joel H. Marr and Teresa K. Marr. After discussing some of the requested changes on the lease it was determined to place the item on the next agenda to discuss in executive session.

Mr. Marr also brought up getting a Quit Claim Deed for the 9.99 acres on the property on the hill on the South side of the Highway, returning a piece of property where the tanks used to be in return for the property that the village has the tanks on now. Mayor Cordova said Rick Gutierrez had a copy of the Quit Claim Deed and just needed to go to the court house to record it. Village Attorney Jeff Rhodes wondered as to where the deed came from, who prepared it, what description was used etc. Mr. Marr said Rick researched the property, typed out a Quick Claim Deed description from the property he researched. Mr. Marr said the village purchased it from his dad and when they couldn't use it the village was supposed to give it back. Village Clerk Dianna Brusuelas-Guilez told the Village Attorney she would have Rick Gutierrez take him the file. Trustee Patrick Garcia asked if all this could be started over because he is totally concerned about the legal aspects. Trustee Robert Sainz commented that if there is a Quit Claim Deed involved it should go through the efforts of the attorney to set it up.

Trustee Patrick Garcia moved to table until the next meeting to discuss in the executive session. Trustee Ronald Cooksey seconded the motion.

7. Judge Billy Artiaga-Request funding be transferred back to courts that was transferred out in 2012

Judge Billy Artiaga asked that funding that had been taken out of his budget be transferred back to the judicial area stating that he would like to purchase new equipment at a price of $16,000.00. If there is $11,000.00 in his budget then he would only approach the board for $5,000.00 which would later come from the Court Automation Fund and be reimbursed. Judge Artiaga explained that he has taken the Community Service back into his court because he feels that court business should stay within the court system and should not be farmed out to a non-court employee. Mayor Ray Cordova said he did not see justification for the equipment and doesn't feel the court has the volume to support the request. Trustee Ronald Cooksey asked the Judge if he wasn't overloading his clerk. Village Attorney Jefferson Rhodes tried to clarify saying that equipment is a capital, one time, expense where someone's salary is operational and a recurring expense. Trustee Robert Sainz asked if the $11,000.00 plus was initiated from the Judicial area and for how long was it there. Mayor Cordova responded that it was not being used and was given back. Trustee Sainz said if it was in the judicial area and was turned over to the legislative area and since we have a new judge who has a need for that money then we should transfer it
back. Mayor Cordova said his court lacks for nothing. Trustee Patrick Garcia asked what the money would be used for and the Mayor's response was to pay the Resource Officer to continue the community service with the courts in Alamogordo and the Adult Probation Office.

8. Mayor Ray S. Cordova-Approval of three month extension of trial period (probation) for Diana Ortega as requested by OAP Director Prestina Chavez

Trustee Patrick Garcia moved to approve the extension and was seconded by Trustee John 'Ray' Telles.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

9. Trustee John 'Ray' Telles-Need to impose a hiring freeze until 2015, unless emergency arises--maybe make some personal changes in house

Trustee John 'Ray' Telles feels that the village does not need any additional employees at this time unless an emergency arises. Trustee Robert Sainz voiced concern that one individual retired and one resigned that put the village in a shortage of two people and the morale issue Trustee Sainz said he would have to vote against the hiring freeze. Trustee Patrick Garcia tends to agree with Trustee Sainz and feels the Mayor should come to the Board to ask for a hiring freeze and the Mayor has not.

Field Supervisor Tim Duran suggested placing Patrick Wooten in his area and when Solid Waste needs him he can do the Solid Waste. Mayor Cordova asked Mr. Duran to come talk to him in the office reference the change.

Trustee John 'Ray' Telles moved to approve the hiring freeze. Motion was seconded by Trustee Patrick Garcia.

Roll Call Vote: Trustee Cooksey, nay. Trustee Garcia, nay. Trustee Sainz, nay. Trustee Telles, aye. Motion failed with three members voting nay and one aye.

10. Mayor Ray S. Cordova-Overtime issues and setting duty schedules

Mayor Ray Cordova explained that there have been three options he has been working on to try to alleviate overtime and sometime possibly in the month of June one of the options would be implemented. Mayor Cordova said he does not want anyone working overtime unless it's an emergency. Right now it is not an agenda item for vote it is just for informational purposes.

Trustee Robert Sainz did identify that the Mayor has asked for input from all department heads and only two had input but requested that the Mayor again extend input from the departments and work something out together. Mayor Cordova agreed that after the schedules are worked on he will call the Department Head to see which one will work the best for that department.

11. Trustee John 'Ray' Telles-Approval to change section 50.02 of the Tularosa Personnel Policy-change 15-mile radius to 20-mile radius

Trustee John 'Ray' Telles explained that he would want all field employees in the weekend duty rotation to help the two employees who are doing it every other weekend.

Trustee John 'Ray' Telles moved to approve. Motion was seconded by Trustee Ronald Cooksey.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

12. Trustee John 'Ray' Telles-Approval to include all field personnel on weekend duty

Item removed.

13. Monica Voorbach - Request to approve the proposal from De'Aun Willoughby CPA, PC, to audit Fiscal Year 2014

Trustee Patrick Garcia moved to approve the proposal from De'Aun Willoughby CPA. Motion was seconded by Trustee Robert Sainz.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Mayor Ray Cordova asked if this was only for one year. The response was the bid was for three years but the proposal which has to be approved by the State Auditors Office goes out once a year so it is brought up to the board once a year also.

14. Tim Duran and field employees-Request to name or dedicate the playground park by the Little League Baseball Field to Goyo Rocha, for 48 years of service

Tim Duran brought up naming the park behind the Little League Field after Goyo Rocha who served the village for 48 years.

Trustee Patrick Garcia brought up an issue that the park has already been named. It was suggested by Trustee John 'Ray' Telles to name the village yard
after Mr. Rocha. Trustee Patrick Garcia asked Mr. Tim Duran to place himself on the agenda for next month to name the Village Yard after Mr. Goyo Rocha.

15. Valarie Delgado-Approval of 2014-2015 Interim Budget
Trustee Robert Sainz moved to approve the 2014-2015 Interim Budget. Trustee Patrick Garcia seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

16. Old Business

Village Attorney Jefferson Rhodes suggested putting American Tower on the next agenda both as an action item and executive session.

Trustee Patrick Garcia asked the Mayor if the employees could be given a copy of the information Village Clerk Dianna Brusuelas-Guilez prepared showing the salary of each employee plus how much the village pays for insurance, PERA, etc., the 2013 Total Benefit Package. Trustee Garcia asked if the Village Clerk could prepare on for each employee so they would know how much is paid out not just the salary. Village Clerk Dianna Brusuelas-Guilez said she would give each employee their information.

David Shields, Bohannon-Huston updated on the progress at the Wastewater Plant project.

Trustee John 'Ray' Telles moved to adjourn and was seconded by Trustee Ronald Cooksey. Meeting adjourned at 8:30 P. M.
