The Board of Trustees of the Village of Tularosa met in a Workshop Setting on Tuesday, November 29, 2011 at 6:00 P. M. in the Court/Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.
Present: Mayor Ray S. Cordova
Trustee Patrick Garcia
Trustee Gloria R. Sainz
Trustee Fred Tyler
Absent: Trustee Joseph Lueras
Village Clerk Dianna Brusuelas-Guilez
Also present was Monica Voorbach AP/Payroll Clerk and Village Attorney Jefferson Rhodes.
Mayor Ray S. Cordova asked all to rise and join him in the Pledge of Allegiance and the Salute to the Flag of the State of New Mexico.
Item 1. Consideration of Agenda and Consent Agenda
Trustee Gloria R. Sainz moved to consider the agenda and the consent agenda. Motion was seconded by Trustee Fred Tyler.
Roll Call Vote: Trustee Tyler, aye. Trustee Garcia, aye. Trustee Sainz, aye. Motion carried with all members present voting aye.
Item 2. Discussion of Prairie Subdivision
Mayor Cordova announced that also present were Mr. Lance Giest and Village Attorney Jefferson Rhodes.
Mr. Lance Giest presented some information to the Board and wondered what the Village expected of him should he purchase the subdivision from Mr. Scott.
Attorney Jeff Rhodes recalled the issue being curbs and gutters stating that the subdivision ordinance includes curbs and gutters unless the Board of Trustees specifically authorizes a subdivision without curbs and gutters.
Mr. Rhodes also recalled that the owner of the Prairie Subdivision, Mr. Scott's view was that the subdivision plat approved by the Board of Trustees does not show curb and gutters so he omitted them. Mr. Rhodes says there is nothing that says sidewalks need to be shown on the plat.
There were minutes where Mr. Scott came before the board asking for a variance but the request died for lack of a second.
There was discussion on the number of lots . Mayor Ray S. Cordova wondered if all the water rights were transferred. Mr. Rhodes recalled getting water rights from Mr. Ernest Stogden when he started the subdivision but if the number of lots increased then the village is owed more water rights.
Mayor Cordova asked that Village Attorney Jeff Rhodes check on the Water Rights.
Mr. Lance Giest was asked to write up a contract describing specifics, the village would then have the attorney look at it before bringing it to the council.
Item 3. Adjourn
Trustee Fred Tyler moved to adjourn and it was seconded by Trustee Gloria Sainz.
The meeting adjourned at 7:10 P.M.
