Regular Meeting-October 17, 2010

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, October 17, 2012 at 7:00 P. M. in the Court Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.
Village Clerk Dianna Brusuelas-Guilez took roll call:

Present: Mayor Ray S. Cordova
Trustee Patrick A. Garcia
Trustee Joseph Lueras
Trustee Gloria R. Sainz
Trustee Fred Tyler

Also present was Village Attorney Jefferson Rhodes, Richard Gutierrez Village Grants Coordinator and Dianna Brusuelas-Guilez Village Clerk.

At 7:00 P. M. Mayor Ray S. Cordova called the meeting to order asking that all rise and join him in the Pledge of Allegiance and the Salute to the Flag of the State of New Mexico.

Item 1. Consideration of Agenda and Consent Agenda

Trustee Fred Tyler brought up a correction to the minutes on item 7 there was no second. Village Clerk Dianna Brusuelas-Guilez said she would check her notes and make the correction. Trustee Tyler then proceeded to move to approve the agenda and the consent agenda. Trustee Patrick Garcia seconded the motion.

Roll Call Vote: Trustee Garcia, aye. Trustee Lueras, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members of the board voting aye.

Item 2. Unscheduled correspondence and public comments

A person from the audience asked if they had heard anything from FEMA. Mr. Rick Gutierrez responded no.

Trustee Fred Tyler thanked the village departments that provided their monthly reports.

Trustee Tyler said he has not seen a sign permit for the new car dealership. Village Clerk Dianna Brusuelas-Guilez said she would check with the cashier.

Trustee Tyler said he went to a Safety Training and the topics discussed were OSHA inspections, Inspection of Public Records and Medical Marijuana in the Workplace.

Trustee Patrick Garcia commended the Fire Department for doing a good job. Trustee Garcia also congratulated Officer Darrel Chavez and Officer Lawrence O'Connor for their promotions and addressed Sergeant O'Connor for the good job he is doing in taking care of the code enforcement issues. Trustee Garcia has seen improvement on the propane place on the highway and Gallegos Lane which has been the source of a lot of aggravation. Trustee Garcia noted the police patrols at the school zones.

Trustee Garcia then asked the status of the new police cars. Mr. Rick Gutierrez said sometime in November.

Mayor Ray S. Cordova said he has received positive commentary on the school zones.

Trustee Fred Tyler thanked the Police Department for the Community Center park patrols.

A private citizen also thanked the police department for being visible.

Officer O'Connor said he has been in law enforcement for over 16 years and commented that these were some of the best dispatchers he's ever worked with.

Item 3. Tommie Herrell-Otero County Commissioner-Information on Quality of Life Gross Receipts Tax

Ms. Jean Killer spoke for Commissioner Herrell passing out a flyer on Otero County's Proposal of the Quality of Life Gross Receipts Tax. The question will be on the November 6th General Election ballot. Ms. Killer explained that only businesses outside the village limits will be imposed the tax and will not be imposed for more than 10 years.

Item 4. Announcement: Tularosa Veteran's Day Observance, November 11, 2012 at the Tularosa Veterans Memorial Park at 11:00 A.M.

Thomas McKean said the program agenda is still being worked on and that there would be a Veteran's Day Centennial Parade on November 10, 2012 at 10:00 a.m.

Item 5. Information: Resignation of Sonya Gililland effective October 12, 2012

Mayor Ray S. Cordova praised the Recreation Director. Both Trustee Patrick Garcia and the Mayor said it was not an 8 to 5 job, Ms. Gililland would work nights with the basketball program, weekends taking kids out of town to Wet & Wild and to the movies on Saturday's or Sunday's. Mayor Cordova said he has been approached by interested parties but when they are told what it entails the interested parties say never mind.

Trustee Joseph Lueras asked what was going to happen to the position and to the program. Mayor Cordova said he does not want to close the program because as it is there is not much for the children. Mayor Cordova said at some point he would advertise but would need to find someone who is very active, good with children, dedicated and committed to the program.

Trustee Lueras asked about the Little League Basketball Program. Mayor Cordova said we would continue that program and that Ms. Gililland volunteered to help setting up schedules, getting referees, coaches etc.

Trustee Garcia said there have been people interested in the past but they may have not been the best choices and feels it is not just a job it is a commitment to young kids, cell phone ringing all the time but she did a tremendous job and is sorry to see her leave.

Item 6. Mayor Cordova/Chief Wood-Promotion of Lawrence O'Connor to the rank of Sergeant with a pay increase to $15.50 per hour

Trustee Patrick Garcia moved to approve and was seconded by Trustee Gloria Sainz.
Trustee Joseph Lueras praised Officer O'Connor but asked if the process had been properly followed asking of there was any conflict with the probationary period. Village Clerk Dianna Brusuelas-Guilez said that she spoke to Chief Wood about that and he looked at the Policy Manual and there was not anything in the manual referencing that so he felt he was in compliance and that Officer O'Connor has had supervisory experience and the leadership is much needed at the Police Department.

Roll Call Vote: Trustee Garcia, aye. Trustee Lueras, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members of the board voting aye.

Item 7. Mayor Ray S. Cordova-Approval of Temporary Employment Agreement with Susan Flores from October 2, 2012 to April 1, 2013 at $10.00 per hour with no more than 20 hours per week as per Chapter II, Section 20.01, Paragraph E of the Village of Tularosa Employee Personnel Policy

Trustee Joseph Lueras moved to approve the Temporary Employment Agreement with Susan Flores from October 2, 2012 to April 1, 2012 at $10.00 per hour with no more than 20 hours per week as per Chapter II, Section 20.01, Paragraph E of the Village of Tularosa Employee Personnel Policy. Trustee Fred Tyler seconded the motion.

Trustee Joseph Lueras wondered about having to post for these Temporary Employment Agreements.

Trustee Patrick Garcia asked what the definition was for Temporary Employment.

Village Clerk Dianna Brusuelas-Guilez explained that the village policy had a 'Term Employee' which is for the duration of a project and a 'Temporary Employee' which is hired for a designated period, has no right to grievance or appeal and will be informed in writing as to the duration.

Roll Call Vote: Trustee Garcia, abstained. Trustee Lueras, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with one board member abstaining and three members of the board voting aye.

Item 7(A) Approval of Gannett Flemings recommendation, Silva Electric and Construction, LLC for sludge removal and disposal as per letter dated 9/25/2012

Trustee Patrick Garcia said judging from the bids Silva's Electric seemed to meet all the bullets and requirements and moved to approve. Trustee Joseph Lueras seconded the motion.

Trustee Fred Tyler asked if the village has to wait for RUS funding. Mr. Rick Gutierrez explained that the funding is there, we just have to submit the letter of award and the letter to proceed. Village Clerk Dianna Brusuelas Guilez also said they would need a copy of the minutes showing the approval of the recommended company.

Roll Call Vote: Trustee Garcia, aye. Trustee Lueras, aye. Trustee Sainz, aye. Trustee Tyler, aye. Motion carried with all members of the board voting aye.

Item 8. Old Business

Trustee Patrick Garcia said that now that Sonya is old business, he asked the Mayor to be very careful on who is selected for that job and asked if the members of the board could have input on the selection stating that he knew she would be hard to replace but hopefully it will be someone comparable.

Trustee Garcia also spoke of a newsletter in the newspaper in place of the police blotter that appears now.

Item 9. New Business

Trustee Fred Tyler asked about the fall clean-up. Mayor Cordova responded that Susan was in the process of getting dumpsters delivered.

Trustee Patrick Garcia asked again about pushing to get bathrooms at the parks.

Trustee Gloria Sainz asked who the parking at the North side of the catholic church belonged to. Mayor Cordova said it belonged to the village except the drive way's could not be blocked. Trustee Sainz said a property owner placed tree trunks and logs. The officers in attendance said they would check into it.

Item 10. Adjourn

Trustee Patrick Garcia moved to adjourn and was seconded by Trustee Fred Tyler. The meeting adjourned at 7:55 P. M.
