Regular Meeting-September 17, 2014

The Mayor and the Board of Trustees of the Village of Tularosa met in a Regular Meeting on Wednesday, September 17, 2014 at 7:00 P. M. in the Court Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present: Mayor Ray S. Cordova
Trustee Patrick Garcia
Trustee Ronald Cooksey
Trustee John 'Ray' Telles
Trustee Robert Sainz

Also present was Village Attorney Jeff Rhodes and Dianna Brusuelas-Guilez Village Clerk.

At 7:05 P. M. Mayor Ray S. Cordova called the meeting to order asking that all rise and join him in the Pledge of Allegiance to the Flag and the salute to the Flag of the State of New Mexico.

Item 1. Consideration of Agenda and Consent Agenda

Trustee Patrick Garcia moved to consider the agenda and the consent agenda. Trustee Ronald Cooksey seconded the motion. Motion carried.

Item 2. Unscheduled Correspondence and Public Comments (3 min)

Trustee Patrick Garcia asked about the flooding on Sacramento Street. Police Chief Charles Wood said that he spoke with Kevin Norman from the State Highway and he was going to bring the vacuum machine to try to clean up the debris that is in the bar ditch.

Item 3. John Hays-Requesting a variance to put a motor home as an office on 420 St. Francis Drive

Mr. John Hays came before the Mayor and Board of Trustees requesting a variance to put a motor home as an office on the property at 420 St. Francis Drive. Mr. Hays explained that he is leasing the property and does not want to place a permanent structure on someone else's property. Mr. Hays said the name of his business is Partners in Grime and will sell firewood, flag stone and landscaping rock. It was suggested to try to purchase the property at 285 Central and put his business there. Mr. Hays said he has researched that property and can't find the owner.

Trustee Robert Sainz asked how long his lease is for and Mr. Hays replied that he has a one year agreement.

Trustee Patrick Garcia moved to allow the variance with a limit of one year and to place the motor home towards the back of the property so that it is not to visible from the highway and to keep the property looking clean. Trustee Robert Sainz seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Item 4. Approval of Final Budget for Fiscal Year 2014-15 as per Section 6-6-5 NMSA 1978

Trustee Robert Sainz moved to approve the Final Budget for Fiscal Year 2014-15. Trustee John 'Ray' Telles seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Item 5. Trustee Ronald Cooksey-Install security cameras at Village Yard, 2 each, one inside building and one outside building

Trustee Ronald Cooksey moved to approve placing security cameras at the village yard amending his motion to purchase and place one camera on the outside of the building. Trustee John 'Ray' Telles seconded the motion.

The question arose as to where the money was coming from. The Board said to have an auction of unused items in all departments, pay for the camera out of cash balances, and then replenish with the auction money.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Item 6. Trustee Robert Sainz-Set working hours for all employees

Trustee Robert Sainz said he has a list of all employees working hours except for Community Service Coordinator/Resource Officer and would like those hours set. Trustee Robert Sainz moved to have a set working hours listed for the CSC/Resource Officer.

Trustee Patrick Garcia seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Mayor Cordova set he would set the schedule for Ms. Flores and send it to the Board Members.

Item 7. Trustee Ronald Cooksey-Bring pavement up to standards on corner of 903 Peach

It was discussed that Tracy Turner from Blue Collar Construction would look at it when he comes to do the street projects. Trustee Patrick Garcia asked to push the Peach Circle project to the front and asked Village Clerk Dianna Brusuelas-Guilez to relay the message to the Project Coordinator, Richard Gutierrez.

Trustee Patrick Garcia then moved to approve bringing up the corner of 903 Peach up to standards and have it be one of the first projects. Motion was seconded by Trustee Ronald Cooksey.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Item 8. Trustee John 'Ray' Telles 1) Request to put Michael Gaston on 8hr days, Monday – Friday 2) Patrick Wooten to run Solid Waste when Mike is on vacation 3) Patrick Wooten to work with Ralph Monday – Friday excluding holidays

Trustee John 'Ray' Telles asked to change his request to put Michael Gaston to work the same hours as the Village Yard employees, 7:00 to 5:00 and 8:00 to 12:00. Trustee Telles also wants to have Patrick Wooten to work with Ralph except when Mike is not working. Patrick Wooten would still run the Solid Waste truck on holidays. Trustee Telles made that in the form of a motion

Village Clerk Dianna Brusuelas-Guilez asked if the effective date could be when she works things out with payroll. The response was yes.

Trustee Ronald Cooksey seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Item 9. Overtime issue – Choose Option 1; Option 2; Option 3

Trustee Patrick Garcia moved to accept Option 3. Trustee John 'Ray' Telles seconded the motion.

Roll Call Vote: Trustee Cooksey, aye. Trustee Garcia, aye. Trustee Sainz, aye. Trustee Telles, aye. Motion carried with all members voting aye.

Mayor Ray Cordova asked Village Clerk Dianna Brusuelas-Guilez for her and the Payroll Clerk, Monica Voorbach, to make the schedule to avoid confusion.

Trustee Ronald Cooksey asked if this would take effect on the next pay period. Village Clerk Dianna Brusuelas-Guilez asked if they could wait until they could get together and make sure the schedule is going to work then call the guys in to explain and make sure they understand.

Item 10. Old Business

Trustee Patrick Garcia asked about updating the website. A customer asked about the minutes being more current. Village Clerk Dianna Brusuelas-Guilez explained that she can't post the minutes until approved by the Board of Trustees, for example the August minutes are not approved until the September meeting and once approved then they are posted.

Item 11. New Business

David Shields gave and update of the projects with everything being on hold for now except that there is a 80/20 grant for the Fire Department that is due September 26th.

Trustee Robert Sainz inquired about the Public Safety Facility building. Trustee Sainz was under the impression that one of the stalls is for AMR ambulance service and AMR is not in there. Trustee Sainz wondered if the village was at risk of having to return all or part of the funding used to build the ambulance bay if the village is not using part of the building as such.

Mayor Ray Cordova stated that it is currently there for their use and if they are not using it, it is because they don't want to. Mayor Cordova assured Trustee Sainz that the village is in compliance.

Trustee Patrick Garcia asked the Village Clerk if she could provide an updated list of the loans and balances, her response was yes she would ask Valarie to prepare.

Trustee John 'Ray' Telles asked for the next meeting a list of all overtime. Village Clerk Dianna Brusuelas-Guilez responded that he could go to the Payroll Department and request it.

Item 12. Adjourn

Trustee Robert Sainz moved to adjourn. Trustee John 'Ray' Telles seconded the motion.

The meeting adjourned at 7:55 P. M.
