Village of Tularosa - Workshop-September 15, 2008

The Board of Trustees of the Village of Tularosa met in a Workshop setting on Monday, September 15, 2008. The meeting was held in the Court/Conference Room of the Public Safety Facility located at 609 St. Francis Drive, Tularosa, New Mexico.

Present: Mayor Ray S. Cordova, Trustee Fred Tyler, Trustee Patrick Garcia, Trustee Thomas McKean, Trustee Gloria Sainz, Rick Gutierrez Grants Coordinator, Sally Singleton Utility Billing Clerk, as well as Dianna Brusuelas Village Clerk.

Absent: Trustee Margaret Trujillo

Mayor Ray S. Cordova asked all to rise and join him in the Pledge of Allegiance.

Trustee Fred Tyler questioned two items on the bills list, while several people commented on the contract with Alamo Disposal. Mr. Ken Riedlinger read from various pages of the contract and stated several items which he felt were in violation of the contract. Mayor Ray Cordova stated that he spoke to a person from the Environmental Protection Agency at the Federal Level and to a gentleman from the Solid Waste Bureau out of Las Cruces. Trustee Tyler explained that the village had to have substantial proof of violations that would hold up in court before the village could terminate the contract without legal liability. Mayor Cordova stated that he would take the advise of the village attorney but would pursue terminating the contract if he is creating an environmental issue. Several people cited accidents, oil spills, environmental issues and late pick ups.

Trustee Thomas McKean asked if the Village Board of Trustees is supposed to approve the pay of the court clerks stating he read that in the Reporter from the New Mexico Municipal League. Village Clerk Dianna Brusuelas was not sure because of the three branches of government, the Judicial, Legislative and Executive and the League has given two readings.

The ICIP List was discussed with a request for an addition from Mr. Fred Tyler to include the Veterans Park. Mr. Rick Gutierrez also advised that Wastewater was moved further down the list, explaining that because of the problems with the Wastewater Plant, Mr. Gil Gallegos an Engineer from Gannett- Fleming West was able to get an RUS grant for the village for $1,650,000. Mayor Ray Cordova explained that there are problems with the new Wastewater Plant some of which include settling, the holding ponds leaking water and sludge and numerous other problems. Mayor Cordova stated that the contractor does not come forth and the matter will probably end up in court but that does not preclude from the village needing a Wastewater Plant. The Village also hired two experts from New Mexico State University and their findings are that they don't see salvaging the Wastewater Plant. Mayor Cordova felt fortunate to have obtained the 1.6 million dollars for a new plant.

Mr. Rudy Clark explained the request for a Memorandum of Understanding asking the Village to be the Fiscal Agent for the Mortgage Finance Authority and CDBG and support proceeded to explain another program called CHDO. Another concern Mr. Clark had was using the alleyway as the entrance for lots 17 and 18 on West 7th Street because there is a ditch on the other side and no other access to the property. Trustee McKean from the village having to do with Habitat for Humanities and questioned the 6,000 sq. ft. requirement per single family dwelling.

Chief Mayberry made a presentation referencing pay for Police Officers. The consensus of the Board was to study the salary schedule, get together with the Clerk and Finance Officer before making any decisions.

Dates were set for a Fall Clean-Up. Questions were raised about the work on 1st Street . Also the weeds at the Library were addressed.
